GENERAL PURCHASE CONDITIONS

These Purchase Conditions establish the terms and conditions applicable to the use of the Website and the purchase and sale of products through the Website and constitute a legally binding contract between us and you. By placing an order on the Website, it is considered that you have read these conditions and accept all of the provisions without exception.

By using the Website and placing orders through the Website, you accept the following:

1. To use the Website exclusively for legitimate queries and orders.
2. Not to place false, indeterminate or fraudulent orders. If we have reasonable belief that orders of this type have been made, we reserve the right to cancel the purchase and, if necessary, notify the pertinent authorities.
3. To provide your email address, postal address or other accurate contact details. You accept that if we need to contact you, we will use the information provided by you to do so (consult our Privacy Policy).
4. If you do not provide all of the information that we require in order to verify your order, it is possible that we may not be able to complete the order process.
5. By placing an order on the Website, you declare that you are over 20 years old and have the legal capacity to enter into a binding contract.

The products and services offered on the Website are only available for orders placed in Japan.

The information stated in these Purchase Conditions and the details included on the Website are not an offer for sale but rather an offer for purchase by order. The contract between us and you will be completed when we have expressly accepted your offer and your order in itself does not constitute a contract between us and you for any product or service.

If the company does not accept your order and the price has already been charged to your account, you will be refunded the full amount. Once you have placed your order, you will receive an email confirming that we have received your order (‘Confirmation Document’). This Confirmation Document does not mean that your order has been accepted, but that you have offered to purchase products through your order. All orders require documented acceptance from us and we will recognize this by sending an email confirming that the products ordered have been sent (‘Shipping Confirmation’). The contract between us and you for the purchase of the products requested (‘Sale Contract’) will be completed when the Shipping Confirmation is sent to you.

The Purchase Contract is only valid for the products described in the Shipping Confirmation email. In the case of products requested for which we have not yet issued a Shipping Confirmation, we are not obliged to provide the product, accept the order or send the product until we have sent said Shipping Confirmation.

All orders are subject to the availability of the products requested. If a product is not available or is out of stock, the company will not accept the order and will fully refund the money already paid by the customer.

The products, information and content of the Website may be removed, deleted or edited at any time without prior warning. In all cases, we will do everything possible to process all of the orders, but in exceptional circumstances it is possible that we may have to reject the processing of an order after confirming it. The Company reserves the right, at its own discretion, to deny processing of any order, including, but not limited to, removing any product from the Website, deleting or editing any information or content, or deleting or editing any order confirmation as well as rejecting orders after the order confirmation, whether the merchandise in question has been sold or not, without the Company having any liability to you or to third parties.

Unless we cannot provide the goods in virtue of Section 5 of these Purchase Conditions or there are other special circumstances, we will do everything possible in order to deliver the goods specified in the shipping confirmation email on the expected date of delivery indicated in the email. If there is no estimated delivery date, the estimated delivery date will be within the 15 days following the Shipping Confirmation date. However, delays may be caused to delivery by unforeseen events.

If for any reason we cannot deliver your order on the expected date of delivery, we will explain the situation and you will have the option of continuing to order the articles requested with a new delivery date or cancelling the order and receiving a full refund of the money paid (where applicable). For the purposes of these conditions, ‘delivery’ is understood to be the moment in which the goods acquired are delivered to the specified delivery address and receipt is acknowledged.

Shipping fee: Free shipping for orders over 10,000 yen. For orders below 10,000 yen, the shipping fee will be 550 yen.

If you do not receive your order after three (3) delivery attempts, we will store it in a safe space. You will receive a notification of where the package is and how to collect it. If you cannot collect your package in the manner indicated, please contact us so that we can arrange delivery.

If you have not contacted us after 15 days from the date of the first delivery and you have not received your product through no fault of the company, it will be deemed that the you wish to cancel the order and the contract will be cancelled. In the case of cancellation of an order, we will refund you the money already paid for the product within a period of 30 days from the date on which the order is considered to have been cancelled. In this case, the cost of delivering the product which has not been received and any other cost arising from the cancellation of an Order Agreement shall be borne by you.

The risk passes to you once the product has been delivered to you. The property of the goods is transmitted to the customer once the Company has received all of the payments for the goods, including the shipping costs, or once the goods have been delivered (as defined in Section 7), whichever occurs later.

The prices of the products are those stated on the Website, except in the case of viewing error. Although we make an effort to guarantee that all prices are shown correctly on the Website, errors may occur. If we discover an error in the price shown for any product after you have placed an order, but before we have confirmed shipment of the product, we will notify you immediately and you will have the option to continue with the order at the correct price or to cancel the order. If you do not contact us within a reasonable period of time, the order will be deemed cancelled and you will receive a full refund of the money paid for the product.

If the error in the price shown is reasonably obvious and you have placed an order knowing that the price was incorrect, we are not obliged to sell the product at a price lower than the correct price, even if the order has already been confirmed for shipment.

The prices shown for the products sold on the Website include VAT. The shipping costs are not included in the prices shown, these are added to the total price to be paid in the order form (see Purchase Guide).

The prices of the products are subject to change without prior warning. Except in the case of price changes due to typographical errors, the prices of items will not be changed once a Shipping Confirmation email has been sent for the order.

Once you have added the items you wish to purchase to your cart, follow these steps to complete your order and make payment.

1. Click on ‘See cart’ on the top right corner of the page.
2. Click on ‘Continue with the order process’.
3. Verify your contact details, delivery address, payment methods, shipping costs and order details.
4. Click on ‘Finalize order’.

We accept the following payment methods: PayPal and Adyen.

Products can also be purchased by guests. By placing an order as a guest, you will only be asked to provide the information necessary for the purchase. You can decide to register as a user or continue as a guest after placing the order.

1. Return by order cancellation/exchanges
   • (i) Once the order has been submitted and the contract has been signed, you can cancel and return the order (except in the case of products that cannot be returned or exchanged which are described below), and/or change a size, provided that you notify us through a prescribed procedure within the period of thirty (30) days from the date of receipt of the product. However, for cocktail dresses, the maximum period for return, as stated on the product description sheet, is 14 days from the date of receipt of the product. You must contact our customer service ([email protected]) to request a return or size change. Returned products must be sent to the Shin-Kobe Macro Store. The first return per order is free of charge, the second and subsequent returns are at your expense.
   • We will examine the articles returned and contact you to confirm whether we can refund the money. Take into account that we cannot return or exchange an item if it has been used or damaged. In the case that a refund is possible, it must be made without delay within a period of 30 days, starting from the date of receipt of your notice of cancellation of the order and receipt of the package in store.
   • Returns must be made through the payment method specified by you at the time of purchase.
   • Earrings cannot be returned or exchanged once the Purchase Contract has been signed.
   • Information regarding returns/exchanges will also be included in the confirmation email.
2. Return of defective products
   • If, upon receiving the product, you believe that it is not in line with the specifications shown on the Website, please contact us immediately through the Contact Form or by telephone at Adolfo Domínguez, providing details of the product and its damaged state. We will inform you of the procedure to follow.
   • Defective products can be returned to any Adolfo Domínguez store in Japan. For further information, consult the Purchase Guide page on this website). We will examine the products returned and contact you by email or telephone to confirm whether a refund or exchange is possible. Returns or exchanges can take place quickly and in a period of 30 days from the date on which the company notifies the customer that the refund or exchange is available.
   • If you return a product because it is defective or damaged, you will receive a full refund of the price you have paid. The money will be refunded through the payment method specified by you at the time of purchase. The refund/exchange policy is understood not to infringe upon your legal rights as a consumer.
3. In-store purchases and returns
   • For in-store purchases and returns, it is essential to present the invoice or receipt. The amount paid will be refunded through the same payment method that was used for purchase. In the case of payment by card, the refund will only be made to the holder of the card used for purchase. In transactions with a gift receipt, the amount will be refunded if the purchase receipt is presented. If this is not available, a refund voucher will be issued (without an expiration date) for the amount corresponding to the item returned.

Except where the contrary is expressly stated in these Purchase Conditions, our liability for the purchase of any product on the Website will be limited to the price of the product. However, nothing included in these Purchase Conditions will exclude or limit our liability for death or personal damages caused by our negligence, fraud or fraudulent misrepresentation, or if it is determined that the exclusion or limitation of our responsibility or any attempt to exclude or limit our responsibility is illegal.

To the extent provided for by law and unless stated otherwise in these Purchase Conditions, under no circumstances will we be liable for any indirect, incidental or consequential damages, including but not limited to damages due to non-compliance with the contract or improper behaviour, including negligence, regardless of the cause or basis, even if said damages are foreseeable, including but not limited to:

1. any loss of income or profit;
2. loss of business opportunities or;
3. loss of profits or contracts;
4. loss of savings anticipated;
5. loss of data or other assets; and
6. loss of management or work time.

Due to the public nature of the Website and possible errors in the storage and transmission of digital information, we do not offer any guarantee regarding the accuracy or security of any information transmitted or obtained on the Website, unless the contrary is expressly stated on the Website.

No guarantee, express or implicit, is offered in relation to the descriptions of the products, the information and the presentation material for any product on the Website. To the extent provided for by law, we do not offer guarantees of any type except for those that cannot be legally excluded as part of a contract with a consumer.

This section does not affect your legal rights as a consumer nor your right to terminate the contract if your purchase is cancelled.

By using the Website, you accept that we may contact you mainly through electronic means (email or via notification on the Website). You accept that we may use electronic communication means in order to notify you when written notification is legally necessary for contractual purposes, and accept that all agreements, notifications, information and emails that we provide through electronic means comply with the legal requirements for written notification. This section does not affect your legal rights.

As a general rule, you must contact us through the Contact Form. Notwithstanding the provisions of the preceding paragraph, except where specified otherwise, all communications that we make will be sent to the email address or contact address provided with your order.

Notifications on the Website/request will be deemed to have been received by you at the time they are published on the Website/request, and in the case of email notifications, they will be deemed to have been received by you 24 hours after we have sent the email. If the notification is sent by mail, it will be deemed to have been received by you three (3) days after the official date of shipment.

Adolfo Domínguez's performance of all or part of its obligations shall be suspended in the event of force majeure that impedes or delays performance. Events that will be considered as such will include but not be limited to: war, riots, insurrection, social disturbances, strikes of any nature and supply problems that cannot be attributed to Adolfo Domínguez.

We will inform you of any such cases of force majeure within seven days of its occurrence. In the case that said suspension is extended for a period of more than fifteen days, you will have the opportunity to cancel the order and we will issue a refund under the conditions established in these General Purchase Conditions.

The fact that we do not insist upon the compliance or execution of your obligations in virtue of the Purchase Contract or these General Conditions, or that we do not exercise any of our rights or resources, will not be considered a rejection or limitation of any of our rights or resources in virtue of the Purchase Contract or these General Conditions, and you will not be released from your obligation to comply with or execute the same.

If we do not demand that you comply with the Purchase Contract or these Purchase Conditions, this will not be considered a rejection on our part and we may insist that you comply with the terms of the Purchase Contract or with these conditions for any later non-compliance on your part. We do not reject any of our rights in virtue of the Order Agreement or these General Conditions, except where the rejection is expressly stated and validly notified.

If any of the provisions in this Purchase Contract or Sale Contract is considered invalid, illegal or inapplicable in virtue of applicable legislation, the provision of this measure will be removed from this Purchase Contract or Sale Contract and the remaining provisions will remain fully valid to the extent provided for by law.

We reserve the right to amend or modify the Purchase Conditions at any time. You are subject to these terms and conditions as enforced at the time of use of the Website or placement of an order. However, to the extent that any change to the terms of this order agreement or the Privacy Policy is required by law or the relevant authority, said changes can be applied in a retroactive manner to any Purchase Contract that you have requested.

This Purchase Contract is written in Japanese and this Purchase Contract and Sale Contract will be subject to the laws of Japan. Any discrepancy related to the use of the Website and this Sale Contract, or derived from the same, will be subject to the non-exclusive jurisdiction of the courts of Japan. This section does not affect your legal rights as a consumer.
